OpenX Software Privacy Principles

The “OpenX Software” is an open source ad serving software platform that allows website publishers to serve advertisements on their websites. The “OpenX Hosted Service” is a service provided by OpenX which allows website publishers to use the OpenX Software on OpenX-hosted servers. We prepared these OpenX Software Privacy Principles so website publishers that use the OpenX Software and the OpenX Hosted Service ("Publishers"), and end users of such Publishers' websites ("Users"), could learn more about information privacy in connection with the OpenX Software and OpenX Hosted Service.

Except as otherwise noted in these OpenX Software Privacy Principles, OpenX’s data collection and use practices for the OpenX Software apply to the OpenX Hosted Service.

1. Information We Collect Specifically Through The OpenX Software and OpenX Hosted Service.

(a) Dashboard Information . The OpenX Software provides Publishers with a dashboard to manage and track ad campaigns. We collect server logs of accesses to this dashboard, including IP address, the number of times a particular page is viewed and other usage information. In addition, we provide content on this dashboard page, such as the aggregate number of ads being served across all OpenX Publisher websites. To achieve this, OpenX software passes an anonymous, unique ID to the central OpenX servers. Publishers who use the OpenX Software may decline to share the information disclosed in this paragraph with OpenX by adjusting the update settings on their OpenX Ad Server. This option is not available to Publishers who use the OpenX Hosted Service.

(b) Ad Server Heartbeat Information. For maintenance purposes, the OpenX Software connects to a central server managed by OpenX and provides information such as IP address, operating system, Web server, database type and version, and aggregate ad serving information such as total number of ad impressions and clicks. Publishers who use version 2.62 (or lower) of the OpenX Software may opt out of the collection of the information in the foregoing sentence by choosing not to receive OpenX Software updates. Publishers who use version 2.63 (or higher) of the OpenX Software may (i) opt out of the collection of aggregate ad serving information by using the opt out procedure located in the settings section of the OpenX Software; and/or (ii) opt out of the collection of the server IP address, operating system, Web server, database type and version by choosing not to receive OpenX Software updates. Neither of the foregoing options is available to Publishers using the OpenX Hosted Service because the service operates on servers owned or leased by OpenX.

(c) Consumer Data. OpenX Software may collect anonymous usage information that does not reflect or reference an individually identifiable User ("Non-Personal Information"). This Non-Personal Information may include information normally in Web server logs such as OpenX cookie information, IP address and page request details. OpenX collects additional Non-Personal Information in connection with the operation of its “OpenX Market,” a Web-based marketplace for the exchange of online advertising. If you are a User and you do not want advertising served to you on the basis of the OpenX Cookie, you will find instructions on how to opt-out.

(d) Plug-In Data. The OpenX Software and OpenX Hosted Service collects information concerning the use of plug-ins for the OpenX Software. Publishers who use the OpenX Software may opt out of the collection of such information by not installing such plug-ins or by electing to not receive software updates for the OpenX Software. Publishers who use the OpenX Hosted Service may not opt out of the installation of such plug-ins or the collection of such information.

(e) OpenX Hosted Service. OpenX collects all of the foregoing information from the OpenX Hosted Service. Because the OpenX Hosted Service is hosted on servers owned or leased by OpenX, all information ordinarily collected by Publishers using the OpenX Software is collected by OpenX on behalf of Publishers who use the OpenX Hosted Service. Additionally, OpenX collects information concerning Publishers’ use of the web-based interfaces of the OpenX Hosted Service, including Publisher’s Non-Personal Information and dashboard usage information. With respect to advertisements hosted through the OpenX Hosted Service, OpenX collects the URL, advertiser, type of ad, number of impressions and other related information. In the future, OpenX may collect personal information from Publishers who use the OpenX Hosted Service if necessary to make payments to such Publishers for advertising revenue generated using the OpenX Hosted Service and (in the case of high volume Publishers) to receive payments from such Publishers for fees associated with the OpenX Hosted Service. This information includes the Publisher’s name, email address, physical address, country of residence, telephone, fax number and credit card, bank account and other information necessary for OpenX to make and receive payments to and from such Publishers.

2. How We Use Information We Collect Specifically Through the OpenX Software and OpenX Hosted Service. We use the information we collect through the OpenX Software and OpenX Hosted Service in order to host and operate the OpenX Hosted Service, to provide Publishers with useful information, to provide maintenance in connection with the OpenX Software and OpenX Hosted Service, to investigate compliance with OpenX’s policies and terms and conditions and to further develop and improve the OpenX Software, OpenX Hosted Service and related products and services, including the OpenX Market and OpenX Software plug-ins.

3. Publisher's Privacy Policy Applies to Users. Users should read each Publisher's own privacy policy to learn how the Publisher collects, uses, and protects information that it may collect or that may be collected in connection with Publisher's website. While we encourage Publishers to adopt information privacy practices consistent with ours, we are not responsible or liable for any Publisher’s information privacy practices or the privacy practices of a Publisher’s advertisers or other business partners.

4. Changes. From time to time, we may change these OpenX Software Privacy Principles. If we decide to change these Principles, in whole or in part, we will inform you by posting the revised Principles on the OpenX website. Those changes will go into effect on the Effective Date disclosed at the end of the revised Principles. Your continued use of the OpenX Software or the OpenX Hosted Service constitutes your agreement to abide by the OpenX Software Privacy Principles as revised. If you object to any such revisions, your sole recourse shall be to stop using the OpenX Software and the OpenX Hosted Service.
